1. Introduction and scope

This Privacy Policy (the “Policy”) explains how CloudAD (the full company name is given in the final section; the “Company”) collects, processes, uses and protects your personal data when you use the cloudad.tech website and its online services (newsletter subscription, contact and enquiry forms, and the clouda conversational partner, together the “Services”).

You are free to choose whether to provide personal data; if you decline to provide necessary data, some functions may not be available. By starting to use the Services, you confirm that you have read and agree to this Policy. The Company may update this Policy from time to time and will post the updates on this website; we recommend that you review it periodically.

2. Purposes of collection and categories of personal data

The purposes of collection include: providing and improving the Services; responding to enquiries and arranging meetings; consumer and customer management; sending newsletters you have subscribed to; statistical analysis of website traffic and performance; maintaining information security; and fulfilling legal obligations. With reference to the “Specific Purposes and Categories of Personal Data under the Personal Data Protection Act” published by the Ministry of Justice, the Company’s specific purposes include: 040 Marketing; 069 Contracts, quasi-contracts or other legal relationships; 090 Consumer and customer management and services; 136 Information (communications) and database management; 152 Advertising or commercial conduct management; 157 Surveys, statistics and research analysis.

The categories of personal data collected are as follows:

  • Collected automatically when you browse: IP address, browser and device information, browsing history, cookie identifiers (mostly presented in aggregate and not directed at individuals).
  • Newsletter subscription: name, email address.
  • Contact and enquiries: name, email address, telephone number, company name, and any content you choose to provide.

The Company does not collect your financial information (such as credit card numbers or bank account numbers); please do not provide it in conversations or forms. The data categories correspond mainly to C001 Personal identifiers and C102 Agreements or contracts.

3. clouda conversational partner

  • When you voluntarily leave your contact details for a follow-up consultation, the Company collects: company name, contact person’s name, email address, telephone number (optional), convenient contact times and time zone, the marketing data challenges you describe, and a summary generated by the system in real time from that conversation.
  • To improve the quality of clouda’s responses and its service, the Company retains conversation content (your questions and clouda’s answers) in anonymous form, accompanied only by a randomly generated session identifier. It does not include your email address, company name or any other data that can identify you personally, and it is not linked to your contact details. In addition, if you submit your contact details, the system generates a summary of that conversation in real time to help a consultant understand your situation.
  • To improve the service, clouda records anonymous usage statistics that do not include conversation content (for example, counts of the number of conversations, whether the contact form was opened and whether contact details were submitted). These statistics are presented in aggregate, contain no personally identifiable data and are not linked to your contact details.

4. Period, region, recipients and methods of use

  • Period: whichever of the following is the longest: the duration of the purpose of collection; the retention period required by law or by contract; the period set by the Company; until you request that use cease or that the data be deleted; or until the date on which the Services cease to be provided.
  • Region: Taiwan and the regions the Services reach, including the operating locations of the service providers described below (some of which are outside Taiwan, for example in the United States).
  • Recipients and methods: the Company and its entrusted service providers process and use the data, within the scope necessary for the purposes of collection, by automated or non-automated means, including identity verification, responses and follow-up contact, aggregated and de-identified statistical analysis, and the prevention of misuse and unlawful conduct.

5. Cookies, advertising tracking and opt-out

This website uses cookies and similar technologies to keep the site running, remember preferences and analyse traffic. This website also uses tracking technologies (such as cookies and web beacons) of third-party advertising and analytics platforms such as Google and Meta for traffic analysis and for serving interest-based advertising and measuring its performance; data collected by these technologies does not directly reveal your name or contact details.

You can manage or refuse tracking at any time:

  • Browser settings: refuse or delete cookies in the settings of your browser, such as Chrome, Safari or Edge.
  • Google personalised ads: turn them off in Google Ads Settings (adssettings.google.com).
  • Meta personalised ads: manage them in the ad preferences of your Facebook/Instagram account.

6. Third-party service providers and cross-border transfers

To operate the Services, the Company engages the following service providers to process certain personal data, to the extent necessary and in accordance with the Company’s instructions: Google (analytics and tag management, such as Google Analytics 4 and Google Tag Manager), Supabase (clouda back end and database) and the advertising platforms described in Section 5; newsletter delivery is entrusted to Brevo.

Some service providers are located outside Taiwan (for example, in the United States and Europe), so your personal data may be transferred, stored or processed outside Taiwan. International transfers are handled in accordance with Article 21 of the Personal Data Protection Act. Except where the central government authority in charge of the relevant industry restricts a transfer under that Article (where major national interests are involved; where an international treaty or agreement contains special provisions; where the receiving country lacks sound regulations on personal data protection, so that the rights and interests of data subjects may be harmed; or where the transfer is made through an indirect method to circumvent the Act), the Company may carry out international transfers, and requires its entrusted service providers to adopt protection measures comparable to those in this Policy.

7. Sharing of personal data

Apart from the entrusted service providers described above, the Company will not sell or rent your personal data, or provide it to any other third party (including the Company’s affiliates and other members of the iKala Group) for their own independent marketing or other purposes. The following situations are exceptions: where you have given your consent; where required by law, or where requested by a competent authority or judicial authority in accordance with the law; where necessary to prevent imminent danger to the life, body, freedom or property of you or a third party; or where provided to the extent necessary to determine responsibility in a dispute or controversy.

8. Minors, the EU and third-party links

The Services are not directed at minors and are not offered in the European Union (EU) or the European Economic Area (EEA). The Company does not intend to collect personal data of minors or of persons located in those regions, and will delete any such data obtained inadvertently. The Services may contain links to third-party websites or applications; their privacy practices are beyond the Company’s control, and the Company accepts no responsibility for them.

9. Personal data security

The Company takes reasonable technical and administrative measures (such as encryption in transit and in storage, access control, and limiting access to personnel who need to know the data for their duties) to protect personal data from loss, misuse, unauthorised access, disclosure, alteration or destruction. clouda conversation content is retained only in anonymous form (without personally identifiable data); in addition, the necessary summaries and contact details are retained. Please keep your account information safe; if your account is used without authorisation, or if you have any other security concerns, please notify the Company immediately.

10. Rights of data subjects and how to exercise them

Under the Personal Data Protection Act, you may exercise the following rights with respect to the personal data held by the Company: to make enquiries or request to review the data; to request copies; to request supplementation or correction; to request that collection, processing or use be stopped; and to request deletion. Please write to the Company’s personal data protection contact (see the final section). To protect your rights and interests, the Company may defer processing your request until it has verified your identity, and may charge a necessary fee as permitted by law. Where the data must continue to be retained because of legal requirements or business necessity, the Company may refuse the request, or handle the data instead by archiving, de-identification or similar means.

11. Amendments to this Policy and contact details

The Company may amend this Policy at any time; amendments take effect once posted on this website. Where required by law, the Company will notify you by appropriate means.
